إنّ أولى ما أعملت فيه العقول وعلقت به الأفكار وعني الفقهاء بجمعه وتصنيفه، وأجهدوا أنفسهم في ترتيبه وتأليفه هو علم فروع الشريعة من الحلال والحرام فإن بها صلاح العواقب ونجاح المطالب وعلو المراتب.
وإن أخص ما عني به الفقهاء علم الأقضية والأحكام المتداولة بين القضاة والحكام، فإن الاصلاح بين المتحاكمين، وأخذ حق المظلوم من الظالم فيما يجري بين المتخاصمين من أجلّ الأعمال وأفضل القربات إلى الله تعالى إذا أُدي وفق ما أمر الله تعالى.
وقد بذل فقهاء المسلمين جهداً عظيماً في سبيل تسهيل سبل معرفة أحكام الإسلام ليقفوا عند حدودها ويضمنوا عدم مخالفتهم لها، فإذا لم يتحقق ما أُمل به، وخالف بعض الأفراد فتجاوزوا أحكامه فقد نصب الشرع ولاة أمور يحملون الناس على الالتزام وعدم الاعتداء على حقوق الآخرين، وأوجب على المخالفين عقوبات رادعة زاجرة تتناسب ومقدار المخالفة.
وإن الجهة المسؤولة عن تنفيذ احترام حقوق الآخرين وتعاقبهم على مخالفة أحكام الإسلام هي جهة القضاء المنصوبة من قبل الدولة الملزمة بتطبيق الأحكام التي يصدرها القضاة.
والشريعة الإسلامية بما تفردت به من ميزات اعتنت بهذا الجهاز أشد الاعتناء فشرعت الأحكام اللازمة لوجود مؤسسة القضاء وبينت شروط من يتولاه ووضعت الضوابط والأصول التي تقوم عليها جميع المتعلقات التي يتناولها.
