Book Description
يقصد بعلم الإجرام ذلك العلم الذي يدرس الظاهرة الإجرامية le phénomène criminel للوقوف على أسبابها تمهيداً للوصول إلى أنسب الأساليب للقضاء على هذه الأساليب أو الحد من تأثيرها بقدر الإمكان.
وتبدو أهمية هذا العلم في أن مكافحة ظاهرة الإجرام في مجتمع ما تصبح أيسر وأكثر فاعلية متى استندت إلى تحديد وفهم صحيحين لأسباب تلك الظاهرة في هذا المجتمع.
علم الإجرام وقانون العقوبات: من التعريف المتقدم لعلم الإجرام يتضح أن هذا العلم كيانه المستقل عن قانون العقوبات، فبينما قانون العقوبات نظام قانوني يشتمل على مجموعة من قواعد السلوك التي تتمتع بقوة الإلزام القانوني وتفرض على المخاطبين بها تحت تهديد الجزاء الجنائي الإمتناع عن أعمال معينة تضر بالمجتمع أو القيام ببعض الأعمال التي يقتضيها الصالح العام، فإن علم الإجرام علم نظري بحت مهمته تقصي أسباب الإجرام وتحديد مدى مساهمة كل منها في خلق ظاهرة الجريمة وذلك عن طريق دراسة أشخاص المجرمين وكافة الظروف المحيطة بهم.
ومع ذلك فثمة علاقة وثيقة بين علم الإجرام وبين قانون العقوبات ترجع إلى وحدة الموضوع الذي ينصب عليه كل منهما، أي الجريمة، وتبدو في التأثير المتبادل الذي يحدثه أحدهما على الآخر وذلك على النحو المبين.
