هذه دراسة فى قانون العقوبات مقارنة بالفقه الإسلامى فى بعض الجرائم. هذا وقانون العقوبات ينقسم إلى قسمين رئيسين هما القسم العام وهو الذى يتعرض لدراسة القواعد العامة للقانون الجنائى للوصول إلى قواعد عامة تحكم مختلف الجرائم والعقوبات ويرسى الأصول العامة لمحتوى قاعدة التجريم والعقاب.
ولقد أردت أن أعرض لأحكام الشريعة الإسلامية فى بعض الجرائم بإيجاز لكى يكون القارئ على بينه من أمرها من العقوبة الدنيوية والأخروية. ولا أقول أنى قد أتيت بجديد فى هذه الدراسة فقد سبقنى إليه أساتذتى الأجلاء الذين دونت أسماؤهم بمراجع هذه الدراسة. ولكن كان قصدى التبسيط فى العرض فيما يتعلق بالشريعة الإسلامية وحشد الكثير من المستحدث من أحكام النقض حتى يتسنى للباحث الحصول عليها فى موضعها المناسب بسهولة ويسر.
وهذه محاولة فى التعليق على مواد قانون العقوبات وفقاً لآخر التعديلات وتشتمل على الاتجاهات الفقهية الجديدة وما استحدث من أحكام محكمة النقض والمحكمة الدستورية العليا. وسوف نتناول القيود والأوصاف والملاحظات القضائية التى تعين رجال القضاء والنيابة والعاملين فى الحقل القانونى عامة. ذلك أن العدل لا يتأتى إلا إذا كان القاضى على علم بمن كان قبله ونزاهة عن الطمع وحلم على الخصم واقتداء بالائمة ومشاركة أهل العلم والرأى وعلى بينة مما يقضى فيه وكيف يقضى بين الخصوم وهذا لا يكون إلا بالمعرفة التامة بالعلم بما جاء فى قانون العقوبات إذا أن فلسفة قانون القانون تعتمد أساساً على تحديد الجريمة وكيفية إثباتها والسير فى الدعوى منذ وقوعها حتى تنفيذ الحكم فيها.
هذا ومن الفضل أن ينسب الفضل إلى أهله وينسب الفضل فى جمع وتدوين هذه الدراسة إلى جهد السادة الزملاء من رجال القضاء العاملين بمحكمة النقض والمحكمة الدستورية العليا والتفتيش القضائى ورجال الفقه القانونى عامة، ذلك أن هناك جهد سابق وضع الأسس وجهد حاضر عاون فى الإنجاز.
