قامت الدولة الإسلامية على مبدأ وحدة السلطة، فكان الرسول الأعظم هو السلطة التشريعية في كل ما لم يرد به نص في القرآن الكريم، هو السلطة التنفيذية والقضائية وكان الجمع بين هذه السلطات أمر منطقي ومقبول في ضوء محدودية عدد المسلمين وحدود دولتهم الناشئة. ومن المؤكد أن الدولة الإسلامية وفي ضوء المبادئ التي قامت عليها، جسدت دولة القانون، تلك الدولة التي يخضع فيها الحاكم والمحكوم للقانون، ويتساوى فيها جميع المسلمين في الحقوق والالتزامات، لا فرق بين أحمر وأبيض، وعربي وأعجمي إلا بالتقوى.
بل إن الشريعة الإسلامية وضعت منظومة متكاملة لحقوق الإنسان وحرياته عجزت عن بلوغ بعض آثارها المواثيق الدولية والوطنية لحقوق الإنسان، فقامت هذه المنظومة على مبدأ المساواة الفعلية بين جميع المسلمين، وعلى مبدأ الحق والعدل، وعلى حرية العقيدة والعبادة، وحرية الرأي والتعبير، وكفلت الحق في الإقامة والتنقل، والعمل والتعليم والضمان الاجتماعي، وقدست السرية الشخصية والحق في الحياة الخاصة وحرية المراسلات والمسكن. لقد أثار موضوع النظام الدستوري في الشريعة الإسلامية خلافًا ونقاشًا فقهيًا لا يزال محتدمًا حتى اليوم، إذ لم يصل الفقه الإسلامي القديم والمعاصر إلى اتفاق بشأن جزئياته وأحيانًا عمومياته.
