من المعلوم أن التشريع الإسلامي صالح لكل زمان ومكان، لأنه من لدنٍ حكيم عليم بأمور البشر ومستجداتها، فجعل للناس في الإجتهاد والقياس مخرجاً وسبيلاً لما احتف بهم من مشكلات استجدت بعد انقطاع الوحي ونصوص الشرع، ولكن ينبغي أن يضبط هذا الإجتهاد بضابط الشرع، فكيف يمكن ضبط هذا الأمر بضوابط وثيقة، وقيود متينة، كي لا ينحرف المرء عن الغاية الشرعية فيضلّ ضلالاً بعيداً. من هنا تبوأ موضوع الإثبات مكانة سامية في التشريع الإسلامي، واهتم بهذا الموضوع الفقهاء من علماء الشرعية، وكذلك المتأخرون لوضع الأسس اللازمة بهذا الموضوع بما يتناسب مع الحوادث المختلفة على مر الأزمان.
وهذا الكتاب يتناول بالدراسة موضوع الأدوات والوسائل التي استجدت في الوقت الحاضر مما يتوقع صلاحيتها كوسائل لثبوت بعض الأحكام الشرعية في باب العبادات أو المعاملات أو الحقوق والجنايات، حيث يحاول الكاتب من خلال دراسته لهذا الموضوع التعرف على ماهية هذه الوسائل المستجدة وما يصلح منها للإثبات وفق المعايير والأصول الشرعية المعتبرة في باب الإثبات في الفقه الإسلامي.
تأتي أهمية هذه الدراسة من كونها تستحدث وسائل أكثر دقة ليتحقق للناس بها سلامة الحكم الشرعي.
يقسم الكاتب دراسته إلى مقدمة تشتمل على بيان موضوع بحثه، وأهميته ... ثم ثلاثة فصول رئيسة على الشكل الآتي:
الفصل التمهيدي: وسائل الإثبات في الفقه الإسلامي، مفهومها ومشروعيتها وشروطها وأنواعها ودلالتها.
الفصل الأول: وسائل الإثبات المستجدة في العبادات.
الفصل الثاني: وسائل الإثبات المستجدة في المعاملات.
الفصل الثالث: وسائل الإثبات المستجدة في الحقوق والحدود والجنايات. وأخيراً خاتمة تتضمن نتائج الدراسة.
كتاب هام، يجمع ما بين الشريعة والقانون والعلم هدف بدراسته للوسائل المستجدة في الإثبات إلى تقريب الحق واختصار الطرق المتبعة في الوسائل القديمة. وهذا ما يبيّن الحاجة الماسة إلى الوسائل الحديثة إذا أخذنا المفهوم الأعم لدلالة وسائل الإثبات وخصوصاً أن الشرع لا ينافي استخدام هذه الوسائل.
