إن العدل هو أساس الملك، وبه تستقر المجتمعات الإنسانية في حياتها، وعند فقده تصبح حياة الناس مثل الغاب لا يأمن الإنسان فيها على شيء في حياته وممتلكاته، فالإنسان اجتماعي بطبعه، لذلك كان لا بد له من علاقات تربطه بغيره، يترتب عليها معاملات وخصومات وتظالم في بعض الأحيان، سواء أوقع ذلك على الفرد أم المجتمع، فوجب إعادة الأمور إلى نصابها، لتسير من جديد في طريق الحق والعدل، لذلك حرصت المجتمعات بكافة أشكالها على وجود وسيلة لتحقيق العدل المنشود، لأن الظلم إذا حل بمجتمع كان من أهم المعاول في هدمه، فكان للشرع الإسلامي دور كبير في ترسيخ العدل وذلك بالعناية بوسائل تحقيقه، ومنها القضاء، فأفسح للقضاء وأحكامه مجالاً رحباً في الفقه الإسلامي، وحرص أشد الحرص على نزاهته، وأبعده عن كل ما يعكر صفو هذه النزاهة، ويقول قاضي المسلمين الأول : ( إِذَا حَكَمَ الحَاكِمُ فَاجْتَهَدَ ثُمَّ أَصَابَ فَلَهُ أَجْرَانِ، وَإِذَا حَكَمَ فَاجْتَهَدَ ثُمَّ أَخْطَأَ فَلَهُ أَجْرٌ ) .
وأولى مراحل العملية القضائية، هي التوجه إلى القاضي للمطالبة بالحق الذي أصابه التعدي أو الإيذاء، وطريق ذلك رفع الدعوى أمام القاضي، وحتى تكون المطالبة صحيحة ويترتب عليها وصول صاحب الحق إلى حقه، لا بد أن تكون دعواه صحيحة، متوفر فيها الشروط المطلوبة لصحتها، ولذلك كان اهتمام الفقهاء والعلماء ببيان شروطها وتفصيل ذلك بوضوح، حتى تصدر صحيحة تترتب عليها نتائجها.
