لا شك أن موضوع الإسلام والتأمين الذي تناوله الأستاذ "محمد عادل مجركش" وكيل المؤسسة العامة السورية للتأمين بالبحث والتحليل في مؤلفه هذا لمن المواضيع الهامة التي شغلت رجال التأمين في العالم العربي الإسلامي نتيجة فتاوى متعارضة صدرت عن بعض رجال الفقه الإسلامي حول مشروعية التأمين أو عدم مشروعيته وفقاً لأحكام الشريعة الإسلامية في فترات سابقة.
وحيث أنه قد تكرر طرح هذا الموضوع أمام مؤتمرات الاتحاد العام العربي للتأمين أكثر من مرة دون إجابة شافية من أحد...
لذلك فقد كانت هذه المبادرة من الأستاذ مجركش بالتصدي لهذا الموضوع، إنما هي مبادرة ومسؤولة، حرص فيها أن يعزز رأيه بآيات القرآن الكريم المرجع الإلهي الذي لا يأتيه الباطل من بين يديه أو من خلفه، والأحاديث النبوية الشريفة التي جاءت لتكمل رسالة الإسلام السمحة باعتبار سيدنا محمد صلى الله عليه وسلم خاتم النبيين والمرسلين، الأمر الذي يجعل من هذا الكتاب مرجعاً ثميناً استطاع من خلاله أن يسلط الضوء على توافق أحكام عقد التأمين مع الشريعة الإٍسلامية من حيث مفهوم التأمين التعاوني وأهدافه وأغراضه الاجتماعية والاقتصادية والإنسانية، والدور الذي يلعبه في حماية الأفراد وممتلكاتهم ومسؤولياتهم وحماية الملكية العامة, وقد نوه بأن فتاوى بعض رجال الفقه الإسلامي من السادة العلماء الأجلاء التي جاءت بتحريم التأمين ما كانت لتصدر عنهم لو كان ما عرض عليهم من مفهوم التأمين، إنما عرض، بالشكل الصحيح والكامل لمعاني التأمين ووظائفه الاجتماعية والاقتصادية، فأين عقد التأمين من عقود الغرر والمراهنة والجهالة؟؟ حيث لا يختلف اثنان على مشروعية هذه العقود الأخيرة والتي تختلف بشكل جوهري عن نظام التأمين المنتشر الآن في كل بقاع الأرض نظراً للحاجة المتزايدة إلى خدماته.
