سوف نعرض في هذا البحث لآراء الفقه وما استقرت عليه أحكام المحاكم وعلى رأسها محكمة النقض، وما صدر عنها من مبادئ بحسبانها المحكمة التي تنير الطريق نحو التطبيق السليم لنصوص القانون. ورأيت أنه من الأوفق أن تمتزج النصوص بالواقع. وألا أعرض لأحكام القانون بمنأى عن التطبيق العملي لها، لنقف من خلاله على التغيرات والعثرات التي تثار أمام التنفيذ الجنائي، من خلال دراسة أحكامه دراسة تتسم بالطابع التحليلي، إلى جانب الطابع العملي في سهولة ويسر، وفي محاولة تطبيقية شاملة كلي تكون نبراسا نحو الهدف المنشود.
وسوف نعرض هذا البحث في فصل تمهيدي وبابين آخرين: نتناول في الفصل التمهيدي مقدمة عن التنفيذ العقابي، ونتناول في الباب الأول نظام الإشكال في التنفيذ وذلك في فصلين متعاقبين: نتناول في الأول منهما ماهية الإشكال، وأساسه القانوني وتمييزه عن النظم الإجرائية الأخرى ومدى سلطة النيابة العامة في إيقاف التنفيذ. أما الفصل الثاني فسوف نعرض فيه لشروط قبول دعوى الإشكال وما يربط بها من الأسباب التي تنهض عليه.
وفي الباب الثاني نرض للإختصاص بنظر الإشكال وكيفية نظره، وذلك في فصلين: نتناول في الأول منهما الاختصاص بنظر الإشكال أمام المحاكم أيا كان نوعها. وفي الثاني نعرض لكيفية نظره والحكم فيه والطعن في الحكم الصادر في الإشكال ثم نكمل ذلك خاتمة نعرض فيها مجملاً لموضوعات البحث وأسسه وأهدافه.
