نظراً لانتشار الحروب بين الدول بالإضافة إلى الحروب الأهلية في المجتمع الدولي والانتهاكات الخطيرة التي حدثت إبان الحربين العالميتين الأولى والثانية والجرائم الدولية (جرائم الحرب والجرائم ضد الإنسانية وجرائم الإبادة الجماعية).
فقد ظهرت العديد من المحاكم الدولية المؤقتة لمحاكمة مجرمي الحرب. ثم كانت الحاجة ملحة وضرورية لإنشاء قضاء جنائي دولي مستقل دائم وبعد جهود دولية مضنية جاء مؤتمر روما تتويجاً لتلك الجهود الدولية والذي انعقد في الفترة من 15 حتى 17 يوليو عام1998م وقد اعتمد مؤتمر روما النظام الأساسي للمحكمة الجنائية الدولية الدائمة وكانت خطوة إلى الأمام وانتصارا للإنسان في ظل الظروف الدولية المتغيرة والمعقدة وسوف نتناول في هذا البحث الجرائم الدولية في ضوء القانون الجنائي الدولي مسلطين الضوء على الشريعة الإسلامية في حالة السلم والحرب وبيان عادات وتقاليد الحروب وكيفية معاملة المجتمع المسلم لغير المسلمين.
وسوف نبحث الجريمة الدولية بوجه عام والنظرية العامة للجريمة الدولية وأركانها وعناصرها والعقوبات المقررة لها ثم نبين الجرائم الدولية المتعلقة بالحرب العدوانية والجرائم ضد السلام ثم الجرائم الدولية ضد أمن البشرية والجرائم ضد الإنسانية بأنواعها المختلفة ثم نبين الجهود الدولية المبذولة لإنشاء قضاء جنائي دولي دائم وصولاً إلى المحكمة الجنائية الدولية الدائمة طبقاً لنظام روما الأساسي.
