يمكن لنا أن نقرر بالأدلة القاطعة أن الشريعة الإسلامية مع أنها شريعة موحاة وغير قلبلة للتبدل والتحور تعد أرقى شرائع العالم وأحوزها على الأصول العامة الثابتة التي يعتبرها الفلاسفة أصول العدل المطلق الذي لا يتغير، وقد وقع اختيارنا على جزئية مفهوم انكار العدالة لكي نوضح من خلالها ذلك الرقي الذي وصلت إليه الشريعة السمحاء في طريق تحقيقها للعدالة، والإجابة على تساؤل مفادة هل عرفت الدولة الإسلامية ذلك المفهوم خلال مجريات حياتها، وحتى يتضح ذلك المضمون علينا أن نجري المقارنة بين الشريعة الإسلامية والقانون الدولي العام في هذا الصدد.
وتجدر الإشارة إلى أننا سوف نشير في هذا المجال إلى مفهوم الأجنبي لدى الشريعة الإسلامية، ثم لدى القانون الدولي العام، وذلك على اعتبار أننا نعرض لمفهوم أنكار العدالة من الزاوية الدولية، ثم نعرض بعد ذلك لمفهوم انكار العدالة في الشريعة الإسلامية، وهل عرض للشريعة هذا المفهوم من خلال تطبيقها، أم أن العدالة والرحمة كانتا - فقط - منهاجاً للشريعة الإسلامية، ثم نوالي بعد ذلك بيان لمفهوم انكار العدالة في القانون الدولي العام.
وعلى هذا، نقسم المؤلف إلى أربعة فصول هي:
الفصل الأول: مسئولية الدولة عن التصرفات غير المشروعة لأجهزتها المختلفة ضد الاجنبي، الفصل الثاني: الشريعة الإسلامية ومفهوم انكار العدالة، الفصل الثالث: مفهوم انكار العدالة في القانون الدولي العام، الفصل الرابع: موقفنا من مفهوم أنكار العدالة.
