يدور موضوع الكتاب حول فلسفة التحكيم وعلاقة مؤسسة التحكيم بالأنظمة القانونية الوطنية. يشير مؤلف الكتاب إلى أن "هناك ثلاث نظريات للتحكيم الدولي، النظرية الانكليزية التي تقول بأن المحكم هو كالقاضي المحلي، اي وعلى سبيل المثال إن محكماً موجوداً في لندن يتصرف كقاضٍ محلي، وهناك النظرية الثالثة فتقول بأن التحكم هو بحد ذاته شكل من أشكال العدالة، فليس من الضروري أن يكون المحكم الذي مقره لبنان لبنانياً، وفرنسا فرنسياً ولندن بريطانياً، التحكم هو نوع مختلف من العدالة ولكنه عدالة دولية حقيقية، فهو شكل من العدالة لا ينبثق من دولة بل من مجموعة الدول، ولقد تضمنت اتفاقية نيويورك تصديق 145 دولة واعترافها بالقرارات التحكيمية، وبذلك أجمعت 145 دولة على القول بأن قرارات التحكيم الدولي هي الوسيلة الطبيعية لحل خلافات التجارة الدولية...". وهذا يعني بحسب "غايار" أن الأطراف أحرار في اختيار وسيلة خاصة لتسوية النزاعات وتفضيلها على القضاء الوطني وفي اختيار وسيلة خاصة لتسوية النزاعات وتفضيلها على القضاء الوطني وفي اختيار شخص القاضي، وفي ابتكار الإجراءات التي تبدو لهم الأكثر ملاءمة كما أنهم أحرار في اختيار القواعد القانونية الواجبة التطبيق ولو كانت تلك القواعد مستقلة عن أي نظام قانوني وطني.
يهدف هذا الكتاب إلى تحديد الأسس الفلسفية لمادة التحكيم من أجل إظهار تناسقها وتوضيح آثارها العملية في مجال فض النزاعات الدولية.
