إن الأسرة في المجتمع الإسلامي دورها كبير، فهى الركن الأول لأمة قال ربها "كنتم خير أمة أخرجت للناس تأمرون بالمعروف وتنهون عن المنكر وتؤمنون بالله..." وقانون الأحوال الشخصية هو القانون الذي ينظم قواعد الأسرة ويضع لها الضوابط الشرعية- من أجل ذلك رأيت أن أشارك مع أخوة لنا في دولة قطر في بيان أحكام الأحوال الشخصية علي ضوء أحكام القانون الذي بضم ثلاثمائة وأربع وعشرين مادة، تتصدره المواد من 1 إلي 7 في أحكام عامة. والكتاب الأول في أحكام الزواج وآثاره ويضم المواد من 8 إلي 109. والكتاب الثاني في الفرقة بين الزوجين ويضم المواد من 110 إلي 202. والكتاب الثالث في الأهلية والولاية ويضم المواد من 203 إلي 206 والكتاب الرابع في الهبة والوصية ويضم المواد من 207 إلي 324.
وسوف نقدم شرح القانون- إن شاء الله- علي أساس المواد وترتيبها والمادة 4/أ حتي يكون أمر مسائل الأحوال الشخصية في متناول القارئ عامة- ورجال القانون خاصة سواء الجالس منهم أو الواقف- فكل مخاطب بقول الله عز وجل "وإذا حكمتم بين الناس أن تحكموا بالعدل".
