Book Description
تعدُّ "مجلة الأحكام العدلية" من أبرز حركات الإصلاحات (التنظيمات) التي تمّت في الدولة العثمانية في القرن التاسع عشر الميلادي، والتي تعدّ لصالح الدولة العثمانية وللفقه الإسلامي بشكل عام، والمذهب الحنفي بشكل خاص. يقول معرّب شرحها المسمى "دُرَر الحكام" المحامي فهمي الحسيني في مقدمة تعريبه: رأت الدولة العثمانية أن الحاجة ماسة لوضع قانون مدني مُنْتَزَعْ من فقه السادة الحنفية، لتنجو محاكمها من الارتباك والاختلاف للناشئين عن الأقوال المختلفة في كتب فقه الحنفية، فانتفعت طائفة من جلّة العلماء ومُبَرِّر زي الفقهاء في ذلك العصر لتضع هذا القانون وتقوم بذلك العمل الكبير.
وقد رأس هذه الجماعة من العلماء أحمد جودت باشا العالم الشهير ووزير العولمة يومئذ؛ فقامت تلك الجماعة بما انتدبت له أحسن قيام، ووضعت "مجلة الأحكام العدلية"، بعد بحث طويل وجهد شديد، وكانت هذه المجلة أعظم آثار الدولة العثمانية منذ نشأتها".
هذا وإن من مميزات "مجلة الأحكام العدلية" على كتب الفقه المتداولة، أنها تمّ تقسيمها على مواقد مرقمة، وهذا الأسلوب على بساطته لم يُسْبَقْ إليه باللغة العربية إلا كتاب "تعريب قانون الحدود والجنايات" المترجم من الفرنسية، وقد استعمل فيه لفظ (بند) بدل (مادة). وقد قام بترجمته ثلان من المترجمين بملاحظة رفاعة بك الطنطهاوي. وهذا الأسلوب تمّ اعتماده عند تأليف هذه المجلة، مع الاستفادة من تعديل المجلة كلمة (بند) إلى (مادة). ولأهمية هذه المجلة تمّ الاعتناء بها في هذه الطبعة حيث جاءت مضبوطة ومشكولة ومنسّقة ومحبوكة المراد مع شرحٍ لبعض غريبها.
