يهدف هذا الكتاب إلى تحديد المقصود بالتنفيذ الاختياري للالتزام وهو الوفاء أي قيام المدين بتنفيذ التزام وبيان الطبيعة القانونية للوفاء والنتائج القانونية وطرف الوفاء وشروط الأهلية والملكية وعدم إضرار الوفاء بالدائنين وإقرار الدائن بالوفاء ومحل الوفاء والوفاء بكل شيء المستحق وعدم التجزئة ثم نفقات الوفاء وكيفية الوفاء وأثار الوفاء مع حلول الوفاء والوفاء في القانون الإنجليزي والأردني والعراقي والمصري والوفاء الاعتيادي في الإسلام ثم يتناول المقاصة أهميتها وفوائدها واعتبارها أداة الوفاء وضمان ثم يشير إلى التطور التاريخي لفكرة المقاصة في الفقه الغربي في القانون الروماني والفرنسي القديم والقوانين الجرمانية والقانون الأردني موضحا تمييز المقاصة عن غيرها من النظم القانونية ثم يعدد أنواع المقاصة وشروط كل نوع وأثار المقاصة بين الطرف ثم يشير إلى اتحاد الذمتين في الحقوق الشخصية والعينية وبين الأحياء واتحادهما بسبب الوفاة ويذكر الشروط الواجب توافرها لتحقق اتحاد الذمتين وأحكام اتحاد الذمتين وتجديد التزام وشروط هذا التجديد وأحكامه ثم يشير إلى التجديد في الفقه الإسلامي ذاكرا المقومات العامة لتجديد ومصادر التجديد وعناصر التجديد الالتزام وشروط سريان تجديد الالتزام في الفقه الإسلامي وتقارير بين الالتزام الجديد والقديم.
