قد تقع على ظهر الطائرة جرائم متنوعة تخضع لأحكام قانون العقوبات الداخلي، كحمل السلاح دون ترخيص، والسرقة والقتل.. الخ. وقد تقع على ظهر الطائرة أيضاً جرائم لا تعد كذلك بمقتضى أحكام القوانين العقابية الداخلية ويكون من شأن تلك الأفعال أن تمس بحسن النظام والضبط على ظهر الطائرة أو تهدد سلامة الطائرة أو تجعل سلامة الأشخاص أو الأموال الموجودة في الطائرة عرضة للخطر.
أما جريمة "اختطاف الطائرة" فيقصد بها إجمالاً قيام أي شخص بصورة غير قانونية وهو على ظهر طائرة في حالة طيران بالاستيلاء عليها، أو ممارسة سيطرته عليها بطريق القوة أو التهديد باستعمالها، أو الشروع في ارتكاب أي فعل من هذا القبيل. ويعدّ الشريك لمن ارتكب أياً من الأفعال الجرمية المذكورة أو لمن يشرع في ارتكابها بمثابة الفاعل الأصلي. وسيأتي شرح أركان هذه الجريمة مع غيرها من المسائل التي تتعلق مباشرة بجريمة خطف الطائرات في هذا الكتاب الذي يتناول وبصورة عامة دراسة خطف الطائرات وذلك على ضوء دراسة في القانون الدولي والعلاقات الدولية الصادرة في هذا الشأن.
