نشأ القانون الدولي العام منذ أن بدأ الإنسان يعيش في تجمعات بشرية نشأت بينها علاقات معينة. وكان الوطن العربي أول المجتمعات الإنسانية التي شرعت القانون الدولي. وجاء الدين الإسلامي بقواعد إنسانية للناس كافة، أطلق عليها السير والمغازي لتنظيم حالتي السلم والحرب، وكانت قائمة على الفضيلة والترفع والإباء. وعلى مر العصور تطور القانون الدولي العام، واختلفت مفاهيمه وتباينت تطبيقاته بحسب الظروف والأحوال. وفي العصر الراهن، كان للتوازن الدولي الدور الكبير في دفع الدول إلى احترام قواعده. وشهدت المرحلة التي أعقبت الحرب العالمية الثانية، العصر الذهبي للقانون الدولي العام. فعقدت العشرات من المعاهدات الدولية المهمة التي تنظم العلاقات الدولية. غير أن انهيار الكتلة الاشتراكية عام 1991، واختلال التوازن الدولي، أدى إلى التفرد بالسياسة الدولية والهيمنة على المؤسسات المهمة المنظمة للعلاقات الدولية بصورة عامة، والمنظمة لقواعد القانون الدولي العام بصورة خاصة. فاختلطت المفاهيم الإنسانية بمصالح الدول الكبرى وسادت مفاهيم العولمة، وعمت الفوضى أرجاء قارات العالم، وجردت المصطلحات القانونية من محتواها القانوني الحقيقي، وتغير معناها. وكان الأمر الأدهى من ذلك كله، أن هذه الانتهاكات حصلت تحت ذريعة تطبيق القانون ومكافحة الإرهاب الدولي. واستخدمت المؤسسات الدولية، لصالح التجاوز على القانون مما أفقده المصداقية، وأفرغ عن محتواه الإنساني.
