لم يكن علم أصول الفقه مدوناً على هذا النمط في عصر الرسول صلى الله عليه وسلم، وكان السلف في غنية عنه لكون الرسول صلى الله عليه وسلم موجوداً فيهم يسألونه كلما استشكل عليهم أمر من الأمور، ولكونهم أرباب اللسان وأهل الصناعة، فكانوا لا يحتاجون في منهم معاني الألفاظ إلى أكثر مما عندهم من الملكة اللسانية والفطرة الإنسانية.
ويقول ابن خلدون في "مقدمته"، "واعلم أن هذا الفن من الفنون المستحدثة في الملّة، وكان السلف في غنية عنه بما أن إستفادة المعاني من الألفاظ يُحتاج فيه إلى أزيد مما عندهم من الملكة اللسانية؛ وأما القوانين التي يحتاج إليها في إستفادة الأحكام خصوصاً فمنهم أُخِذَ معظمها.
وأما الأسانيد فلم يكونوا بحاجة إلى النظر فيها لقرب العصر وممارسة النَّقَلة وخبرتهم، فلما انقرض السلف وذهب العصر الأول وانقلبت العلوم كلها صناعةٌ احتاج الفقهاء والمجتهدون إلى تحصيل هذه القوانين والقواعد لإستفادة الأحكام من الأدلة، فكتبوها فنّاً قائماً بذاته سمّوه: أصول الفقه، وكان أول من دون هذا العلم وأصول قواعده وحرر مسائله هو الإمام محمد بن أدريس الشافعي رضي الله عنه، وذلك عندما أدرك خطر النزاع الذي نشأ بين أصل الحجاز وأهل العراق.
وعلى هذا، فإن علم أصول الفقه من أعظم العلوم قدراً وأرفعها مكانه لكونه يتصل بكتاب الله وسنّة رسول صلى الله عليه وسلم رحلة الفهم لمعانيهما والإستنباط لأحكامها، وبقدر ما يتفاوت العلماء في معرفته تتفاوت بين الناس أقدارهم، وتتباين في الشريعة درجاتهم ومنازلهم.
من دراسة علم أصول الفقه تفي دراسة التشريعة الإعلامية من حيث مصادرها وأدلتها وبيان مقاصدها التي جاءت هذه الشريعة لتحقيقها، والأصوليون هم الناظرون في تلك الأدلة والمصادر وما يعتريها من عوارض، وهم المعتدون الذين يفصلون الأصول ويحررون القواعد من عمومات الكتاب والسنّة وقواعد اللغة عن طريق: الإستقراء، والتتبع، والصقل، والتحرير والتعليل، منهم علماء الأمة ومجتهدوها، رجالها وعظماؤها.
في هذا الإطار كانت هذه الدراسة الأصولية المقارنة التي تعتقد إيراد الدولة، وتوجيهها، ومناقشتها، وبيان الراجح منها، وتوضيح القواعد والمسائل ببعض الفروع الفقهية.
