بديهي القول أن لكل علم مدخلاً يحدد مصطلحاته، ويبين ألفاظه، نشأته وتطوره ومضمونه، خصوصياته ونطاق تطبيقه، فروعه ومصادره. وإذا كان القانون يحتل عند كل مجتمع مكانة خاصة، ودرجة مرموقة، إذ يعد بمثابة أداة لتنظيم سلوك الأفراد والهيئات، ودونه يدخل المجتمع في مراحل من الفوضى والاضطراب، وعدم الاستقرار، فإنه أضحى من اللازم أن تفك الرموز الأولى لهذا العلم، وتعرف الظواهر التي يعالجها، موضوعه، والغرض منه، حتى نميزه عن غيره من العلوم. ولا يكون ذلك قطعاً إلا بدراسة أهم حلقة من حلقات القانون وهي المدخل للعلوم القانونية (النظرية العامة للقانون).
فقبل أن يلقن الطالب نظرية الحق ونظرية الالتزام وأحكام العقود، وأنواع المسؤولية، وقبل أن يدرس أركان الجريمة وصورها المختلفة، وكذا الأحكام التي تنظم عالم الإدارة العامة والمنازعات الإدارية والنظام القضائي وإجراءات التنفيذ وغيرها من حلقات القانون المتصلة والمقررة في مرحلة الليسانس أو البكالوريوس، وجب أن يقف الطالب أولاً عند الممر الإجباري وأن يضع اليد على نظرية القانون ليستلهم المفاهيم العامة، ويستنبط الأدوات الأساسية التي تساعده على النجاح في رحلته القانونية.
فيعرف بدراسة نظرية القانون ماذا يقصد بعبارة القانون، وبماذا تتميز القاعدة القانونية، وما هي خصائصها وما هي أقسام القانون وفروعه، وما هي مصادره الرسمية ومتى يطبق وما هي الصور المختلفة لتطبيقه، وكيف يفسر وما هي الهيئات المنوط بها تفسيره؟
