يجب أن نتذكّر، هنا، أنّ أساس الميثاق الاجتماعي إنما هو المِلكيّة، وأنّ شرطَه الأول أن يظلّ كلُّ واحدٍ ينعم في سلامٍ بما يملكه. لا شكّ في أنّ العهد نفسه يُلزم كلَّ فرد، على الأقل بصورةٍ مضمرة، بأن يُسهم في الحاجات العموميّة. لكن لمّا كان هذا الالتزام لا يضرّ بالقانون الأساسي، وعلى اعتبار أنّ الذين يدفعون الضرائب يعترفون بصدق الحاجة إليها، فإنّنا نرى أنّ هذا الإسهام، كي يتّص يجب أن نتذكّر، هنا، أنّ أساس الميثاق الاجتماعي إنما هو المِلكيّة، وأنّ شرطَه الأول أن يظلّ كلُّ واحدٍ ينعم في سلامٍ بما يملكه. لا شكّ في أنّ العهد نفسه يُلزم كلَّ فرد، على الأقل بصورةٍ مضمرة، بأن يُسهم في الحاجات العموميّة. لكن لمّا كان هذا الالتزام لا يضرّ بالقانون الأساسي، وعلى اعتبار أنّ الذين يدفعون الضرائب يعترفون بصدق الحاجة إليها، فإنّنا نرى أنّ هذا الإسهام، كي يتّصف بالشرعية، لابدّ من أن يكون إرادياً، ليس بصورة فردية، كما لو كان يجب الحصول على موافقة كلّ مواطن، وكما لو كان عليه أن يسهم، فحسب، بما يحلو له (فهذا يناقض مباشرةً روح الحِلاف والاتحاد)، وإنما بناء على إرادة عامة، وعلى تعدّد الأصوات.
