يتناول هذا الكتاب أنموذج امرأة الفقهاء، المقموعة والمقهورة، بسبب الخلاصات الفقهية التي أتى بها المتقدمون، وعمل على تكريسها المتأخِّرون، وامرأة الحداثة التي ظهرت في بدايات القرن الماضي مع اختراق المرأة للمجال العام، وتكرّست مع دخولها ميدان التعليم والعمل، ولكنها تراجعت تحت ضغط التيارات الدينية وممثليها من الفقهاء الذين صبّوا فيضاً من الفتاوى تركزت على علاقة المرأة المسلمة ب يتناول هذا الكتاب أنموذج امرأة الفقهاء، المقموعة والمقهورة، بسبب الخلاصات الفقهية التي أتى بها المتقدمون، وعمل على تكريسها المتأخِّرون، وامرأة الحداثة التي ظهرت في بدايات القرن الماضي مع اختراق المرأة للمجال العام، وتكرّست مع دخولها ميدان التعليم والعمل، ولكنها تراجعت تحت ضغط التيارات الدينية وممثليها من الفقهاء الذين صبّوا فيضاً من الفتاوى تركزت على علاقة المرأة المسلمة بجسدها، وعلى توسيع دائرة المحرَّم،الذي يحاصر الأجساد الأنثوية. الفقهاء التقليديون ومن تبعهم، نظروا إلى المرأة، من موقع المتعة والرغبة والتحصين والنشوز.
وبصرف النظر عمّا خاضه الاصلاحيون في مراحل متأخرة، فقد ترك الفقه التأسيسي تأثيراً أقوى، خصوصاً أن الإسلام التراثي/ الفقهي، تجذر ويتجذر في رؤية المسلمين تجاه ذواتهم والعالم المحيط بهم، وهو الأكثر قدرة على صناعة أفكارهم. سعى الفقهاء إلى تكبيل الذات الأنثوية واخضاعها للخطاب الفقهي/ الذكوري، العائم على بحر من الفتاوى غب الطلب. وتتخطى هذه الفتاوى الجسد الأنثوي لتصل إلى السياسي والثقافي والمجتمعي؛ إذ كلما عجز المجتمع عن قراءة أزماته بعين الحداثة والعلم، حضر الجواب الديني، الذي ينعكس على البناءالمجتمعي برمته.
ليس هناك عودة دورية لسلطة الدين في المجتمعات العربية والإسلامية، فتدخل السلطة الدينية لفرض هيمنتها على المجتمع ظلّ موجوداً على الدوام، لكن ثمة إحياء لظواهر قديمة، تظهر أوْلى تمثلاتها في هذا الكمّ الهائل من المحجَّبات والمنقَّبات. وقد يقول قائل إن حجاب المرأة المسلمة واجب شرعي؛ وبعيداً من التكليف الشرعي، نرى وجود علاقة بنيوية بين تزايد أعداد المحجَّبات والتراجع الحضاري، وهذه الفرضية سندرسها في سياق دراستنا.
