إن قوانين الأحوال الشخصية توالت منذ سنة 2000 وحتى سنة 2005 فأضافت إجراءات جديدة كما أضافت أحكاماً جديدة في مسائل الأحوال الشخصية- فضلاً عن إنشاء محاكم للأسرة ونيابة لها ومكاتب ملحقة بمحاكم الأسرة، واقتصر اختصاص هذه المحاكم ومكاتبها ونياباتها على النظر في مسائل الأحوال الشخصية، فكان الأمر جيداً والإختصاص مفاجأة للقائمين على مسائل الأسرة، ولما كانت المادة الثالثة من القانون رقم (1/ 2000) بإصدار قانون تنظيم بعض أوضاع وإجراءات التقاضي في مسائل الأحوال الشخصية قد نصت على أن "تصدر الأحكام طبقاً لقوانين الأحوال الشخصية المعمول بها، ويعمل فيما لم يرد في شأنه نص في تلك القوانين بأرجح الأقوال من مذهب الإمام ابي حنيفة" فقد تناولنا الإجابة على التساؤلات التي وجهت إلينا عبر الهاتف من جميع محاكم الأسرة في مصرنا العزيزة،مع مراعاة أرجح الأقوال من مذهب الإمام أبي حنيفة- ورأيت أنه من الواجب أن أقدم هذه الأسئلة واجوبتها في هذا الكتاب لعلها تكون مفيدة لقضائنا الجالس وقضائنا الواقف الذي يهتم بمسائل الأسرة في مجتمعاتنا.
