اشتهر قول الإمام الشافعي رحمه الله تعالى : ( لا ينسب لساكت قول ) حتى صارت قاعدة فقهية تأسست عليها الكثيرات من الأحكام الشرعية . فهل هذه القاعدة قاعدة مطردة ؟ وهل يمكننا أن ننسب لساكت قولاً نبني عليه أحكاماً شرعية فلا تكون تلك الكلمة المطلبية على إطلاقها ؟ لقد كان هذا الكتاب هو الجواب الشافي . إذ قام العلامة السوبيني رحمه الله تعالى بجمع المسائل المتناثرة في كتب الفقه والتي أمضى أهل العلم فيها للساكت قولاً ، فخرجت تلك المسائل عن هذه القاعدة الشهيرة . وقد حاول بعض الفقهاء جمع هذه المسائل ، فذكر بعض متقدمي الشافعية من ذلك ست مسائل ، ثم زاد عليه العلامة جلال الدين البلقيني رحمه الله تعالى حتى أوصلها إلى عشرين مسألة وذكر العلامة ابن نجيم الحنفي رحمه الله تعالى في « الأشباه والنظائر » سبعاً وثلاثين مسألة . وزاد عليها العلامة الحموي رحمه الله تعالى في « غمز عيون البصائر » فأوصلها إلى خمسين مسألة . ثم جاء العلامة السوبيني رحمه الله تعالى فتتبع هذه المسائل من كتب الفقه ، فأخرجها من أبواب متفرقة في العبادات والمعاملات وغيرها . ولقد قرَّظ هذا الكتاب الفريد أربعة من العلماء الجلَّة ، وهم : الحافظ ابن حجر العسقلاني . والفقيه القاياتي الشافعي . والفقيه الونائي الشافعي . والعلامة البلقيني . وهذا ما يؤكد أهمية هذا الكتاب وعلوَّ شأنه . وعلى عادة دار المنهاج في اغتنام الجديد النفيس ، والسعي في نشره والاستفادة منه .. سعدت بالمشاركة الفعالة في ذلك ، تقاسم غيرها الأجر والثواب .
