ﺛﺒﺖ ﻓﻲ ﻣﺼﺮ ﻟﺪى اﻟﻤﺤﻜﻤﺔ اﻟﻌﻠﯿﺎ اﻟﺸﺮﻋﯿﺔ أن أول ﺷﮫﺮ ذي اﻟﺤﺠﺔ ﻣﻦ ﻋﺎم (ﺳﻨﺔ 1357) ﻳﻮم اﻟﺴﺒﺖ، ﻓﻜﺎن ﻋﯿﺪ اﻷﺿﺤﻰ ﻳﻮم اﻻﺛﻨﯿﻦ (30 ﻳﻨﺎﻳﺮ ﺳﻨﺔ 1939). ﺑﻌﺪ ﺑﻀﻌﺔ أﻳﺎم، ﻧﺸﺮ ﻓﻲ اﻟﻤﻘﻄﻢ أن اﻟﺤﻜﻮﻣﺔ اﻟﻌﺮﺑﯿﺔ اﻟﺴﻌﻮدﻳﺔ ﻟﻢ ﻳﺜﺒﺖ ﻋﻨﺪھﺎ أن اﻟﺴﺒﺖ أول ذي اﻟﺤﺠﺔ، ﻓﺼﺎر أوﻟﻪ اﻷﺣﺪ، ﻓﻜﺎن وﻗﻮف اﻟﺤﺠﯿﺞ ﺑﻌﺮﻓﺔ ﻳﻮم اﻻﺛﻨﯿﻦ، واﻟﻌﯿﺪ ﻳﻮم اﻟﺜﻼﺛﺎء (31 ﻳﻨﺎﻳﺮ ﺳﻨﺔ 1939). وﻓﻲ ﻳﻮم اﻟﺠﻤﻌﺔ 21 ذي اﻟﺤﺠﺔ (10 ﻓﺒﺮاﻳﺮ ﺳﻨﺔ 1939) ﻧﺸﺮت ﺟﺮﻳﺪة اﻟﺒﻼغ ﻋﻦ ﻣﺮاﺳﻠﮫﺎ ﻓﻲ ﺑﻮﻣﺒﺎى ﺑﺎﻟﮫﻨﺪ ﻓﻲ أول ﻓﺒﺮاﻳﺮ ﺳﻨﺔ 1939: أن اﻟﻤﺴﻠﻤﯿﻦ ﻓﻲ ﺑﻮﻣﺒﺎي اﺣﺘﻔﻠﻮا ﺑﻌﯿﺪ اﻷﺿﺤﻰ ﻓﻲ ھﺬا اﻟﻌﺎم "ﻳﻮم اﻷرﺑﻌﺎء، ﺧﻼﻓﺎً ﻟﻤﺎ أﻋﻠﻦ ﻓﻲ اﻟﻤﻤﺎﻟﻚ اﻹﺳﻼﻣﯿﺔ اﻷﺧﺮى" وﻣﻌﻨﻰ ھﺬا أﻧﻪ ﻟﻢ ﻳﺜﺒﺖ ﻟﺪى ﻣﺴﻠﻤﻰ اﻟﮫﻨﺪ أن أول اﻟﺸﮫﺮ اﻟﺴﺒﺖ وﻻ اﻷﺣﺪ، ﻓﺎﻋﺘﺒﺮوا أوﻟﻪ ﻳﻮم اﻻﺛﻨﯿﻦ. وھﻜﺬا ﻓﻲ أﻛﺜﺮ أﺷﮫﺮ اﻟﻤﻮاﺳﻢ، ﻳﺘﺮاءى اﻟﻨﺎس اﻟﮫﻼل، ﻓﻲ اﻟﺒﻼد اﻹﺳﻼﻣﯿﺔ، ﻓﯿﺮى ﻓﻲ ﺑﻠﺪ وﻻ ﻳﺮى ﻓﻲ ﺑﻠﺪ آﺧﺮ، ﺛﻢ ﺗﺨﺘﻠﻒ ﻣﻮاﺳﻢ اﻟﻌﺒﺎدات ﻓﻲ ﺑﻼد اﻟﻤﺴﻠﻤﯿﻦ، ﻓﺒﻠﺪ ﺻﺎﺋﻢ وﺑﻠﺪ ﻣﻔﻄﺮ، وﺑﻠﺪ ﻣﻀﺢ وﺑﻠﺪ ﻳﺼﻮم أھﻠﻪ ﻳﻮم ﻋﺮﻓﺔ. ﻗﺪ ﻛﺘﺐ اﻟﻌﻠﻤﺎء واﻟﻔﻘﮫﺎء ﻓﻲ إﺛﺒﺎت اﻷھﻠﺔ أﺑﺤﺎﺛﺎً ﻗﯿﻤﺔ ﻧﻔﯿﺴﺔ، ﻓﻲ ﻛﺘﺐ اﻟﺘﻔﺴﯿﺮ واﻟﺤﺪﻳﺚ واﻟﻔﻘﻪ وﻏﯿﺮھﺎ اﺗﻔﻘﺖ ﻛﻠﻤﺘﮫﻢ -أو ﻛﺎدت- ﻋﻠﻰ أن اﻟﻌﺒﺮة ﻓﻲ ﺛﺒﻮت اﻟﺸﮫﺮ ﺑﺎﻟﺮؤﻳﺔ وﺣﺪھﺎ، وأﻧﻪ ﻻ ﻳﻌﺘﺒﺮ ﺣﺴﺎب ﻣﻨﺎزل اﻟﻘﻤﺮ وﻻ ﺣﺴﺎب اﻟﻤﻨﺠﻢ أن ﻳﻌﻤﻞ ﻓﻲ ﻧﻔﺴﻪ ﺑﺤﺴﺎﺑﻪ، وإﻻ ﺷﯿﺌﺎً آﺧﺮ ﻋﻨﺪھﻢ: أﻧﻪ ﻳﺠﻮز ﻟﻐﯿﺮھﺎ ﺗﻘﻠﯿﺪﻳﮫﻤﺎ، أو ﻳﺤﻮز ﺗﻘﻠﯿﺪ اﻟﺤﺎﺳﺐ دون اﻟﻤﻨﺠﻢ. واﻟﻌﻤﺪة ﻓﻲ اﻟﺒﺎب اﻷﺣﺎدﻳﺚ اﻟﺼﺤﯿﺤﺔ اﻟﺘﻲ ﻻ ﺷﻚ ﻓﻲ ﺻﺤﺘﮫﺎ: "ﺻﻮﻣﻮا ﻟﺮؤﻳﺘﻪ وأﻓﻄﺮوا ﻟﺮؤﻳﺘﻪ". ﺛﻢ اﺧﺘﻠﻒ اﻟﻌﻠﻤﺎء: ھﻞ ﻳﻌﺘﺒﺮ اﺧﺘﻼف اﻟﻤﻄﺎﻟﻊ أو ﻻ ﻳﻌﺘﺒﺮ؟ أي إﻧﻪ إذا رؤى اﻟﮫﻼل ﻓﻲ ﺑﻠﺪ، ھﻞ ﻳﺴﺮي ﺣﻜﻢ اﻟﺮؤﻳﺔ وﺛﺒﻮت أول اﻟﺸﮫﺮ ﻋﻠﻰ ﻏﯿﺮه ﻣﻦ اﻟﺒﻼد، وإن ﺑﻌﺪ ﻣﺎ ﺑﯿﻨﮫﻤﺎ، وإن اﺧﺘﻠﻒ اﻟﻤﻄﻠﻊ ﻓﻲ ﻛﻞ ﻣﻨﮫﻤﺎ؟ أو ﻳﻜﻮن ﻟﻜﻞ ﺑﻠﺪ رؤﻳﺘﻪ، ﻓﯿﻜﻮن ﻓﻲ ﻣﺼﺮ ﻋﻠﻰ ﻏﯿﺮ ﻣﺎ ﻓﻲ اﻟﺤﺠﺎز أو اﻟﻌﺮاق أو ﻧﺤﻮ ذﻟﻚ؟، أﻣﺎ اﻟﺸﺎﻓﻌﯿﺔ ﻓﺈﻧﮫﻢ إﻟﻰ أن ﻟﻜﻞ ﺑﻠﺪ رؤﻳﺘﮫﻢ، ﻋﻠﻰ ﺧﻼف ﻋﻨﺪھﻢ ﻓﯿﻤﺎ ﻳﻌﺘﺒﺮ ﺑﻪ اﻟﺒﻌﺪ واﻟﻘﺮب: أھﻮ اﺧﺘﻼف اﻟﻤﻄﺎﻟﻊ، أم اﺗﺤﺎد اﻷﻗﺎﻟﯿﻢ واﺧﺘﻼﻓﮫﺎ، أم ﻣﺴﺎﻓﺔ اﻟﻘﺼﺮ؟! ﻟﻠﺮد ﻋﻠﻰ ھﺬﻳﻦ اﻟﺴﺆاﻟﯿﻦ ﺟﺎء اﻟﺒﺤﺚ اﻟﺬي ﺑﯿﻦ ﻳﺪﻳﻨﺎ واﻟﺬي ﺿﻤﻨﻪ ﻣﺆﻟﻔﻪ رأﻳﻪ ﻓﻲ إﺛﺒﺎت اﻷھﻠﺔ، ورده ﻋﻠﻰ اﻟﺴﺆال ھﻞ ﻳﺠﻮز ﺷﺮﻋﺎً إﺛﺒﺎت أواﺋﻞ اﻟﺸﮫﻮر وﻣﺎ ﺣﻮﻟﮫﺎ، وأن اﻟﻔﻄﺮ ﻳﻮم ﻳﻔﻄﺮون، وأن اﻷﺿﺤﻰ ﻳﻮم ﻳﻀﺤﻮن، وأن ﻋﺮﻓﺔ ﻳﻮم ﻳﻌﺮﻓﻮن. ﻓﮫﺬه اﻷﻣﺎﻛﻦ ھﻲ اﻟﻤﻌﺘﻤﺪة ﻓﻲ إﺛﺒﺎت اﻷھﻠﺔ، وھﻲ اﻟﺘﻲ ﻳﻜﻮن ﻋﻠﻰ اﻟﻌﺮﺑﯿﺔ ﺑﺎﻟﺤﺴﺎب اﻟﻔﻠﻜﻲ؟ وﺧﻠﺺ ﻓﻲ ﺑﺤﺜﻪ ھﺬا ﺑﻌﺪ إﺛﺒﺎﺗﻪ ﻟﻠﻌﺪﻳﺪ ﻣﻦ اﻷﺣﺎدﻳﺚ اﻟﻨﺒﻮﻳﺔ أﺣﺎدﻳﺚ اﻟﺼﺤﺎﺑﺔ واﻟﺘﺎﺑﻌﯿﻦ إﻟﻰ أن: ﻳﻮم اﻟﺼﻮم ھﻮ ﻳﻢ ﻳﺼﻮم أھﻞ ﻣﻜﺔ اﻟﻤﺴﻠﻤﯿﻦ ﻓﻲ أﻗﻄﺎر اﻷرض أن ﻳﺘﺒﻌﻮا ﻣﻄﺎﻟﻊ اﻷھﻠﺔ ﻓﯿﮫﺎ..
