Book Description
الكتاب من تقديم محمد بن سليمان الجراح، وتحقيق جاسم بن سليمان الفهيد الدوسري. هذا كتاب خطة المؤلف بعد "واقعة الجلالية" سعى فيه لبيان أحكام القتال في مكة المكرمة، فتناول المباحث الآتية: أصناف الخارجين عن قبضة الإمام، أحكام قطاع الطريق بالتفصيل، أحكام البغاة وكيفية قتالهم، الفروق بين قتال البغاة وقتال قطاع الطريق، حكم قتال الخارجين في الحرم، حكم الجنايات في الحرم، حكم القتال في الأشهر الحرم، دخول مكة لغير الحاج، أحكام الفوات والإحصار، النية في القتال. ولم يقتصر المؤلف على بيان مذهب الإمام أحمد في هذه المسائل بل ذكر اختلاف العلماء وما احتجوا به لأقوالهم، وبسط القول في حججهم، ونقل من كتب بقية المذاهب تحرياً للدقة، وصاغ ذلك كله بلغة الفقيه المتمرس بمسالك العلل ومضايق الترجيح، وبترتيب ينم عن فهم وبناهة، واستوعب في ذلك جميع الأحكام التي احتاجها المقام. وبالنظر لأهمية هذا الكتاب فقد اعتنى "جاسم الدويسري" على نسخة خطية فريدة مصورة من دار الكتب المصرية، وقد نقلت هذه النسخة من نسخة المؤلف نفسه فهي نسخة موثقة، وناسخها هو إسماعيل بن رجب بن يوسف بن أحمد بن فياض اللبدي الحنبلي، ونسخها في الجامع الأزهر، وتاريخ النسخ سنة (1095) أي بعد وفاة المؤلف بأربع وأربعين سنة. وبالعودة لهمل المحقق نجده قد اهتم أولاً: قتم بنسخ المخطوط، ثم بالمقابلة بين المنسوخ بالمخطوط، وأصلح ما فيه من تحريف وتصحيف. ثانياً: رقم الآيات القرآنية. ثالثاً: خرج الأحاديث والآثار الواردة في الكتاب وحكم عليها بما تقتضيه قواعد فن مصطلح الحديث. رابعاً: خرج النصوص التي نقلها المؤلف من المصادر مع ذكر الاختلافات والفروق، وأشار إلى ما اقتبسه منها بغير عزو منه. خامساً: علق على بعض المواضع بشرح غامض أو توضيح مشكل أو ترجمة لعالم أو تفسير لفظة غريبة، أو ذكر رأي مخالف لما ذكره المؤلف... إلى غير ذلك. سادساً: وضع عناوين تفصيلية بين حاصرتين لتقريب الكتاب إلى مطالعه. سابعاً: كتب ترجمة وافية للمؤلف.
