إن هدف كل حكم جيد هو السعي نحو اقتراب الحقيقة القضائية - التي يتوصل إليها القاضي عن طريق الحكم - من الحقيقة الواقعية، ولايتم ذلك إلا إذا كان هذا القاضي متقنا لفن العمل القضائي، ذلك أنه إذا كان القانون علما من العلوم الانسانية، فإن تطبيقه على وقائع النزاع يعتبر فنا. ممارسة هذا الفن يرتقي بالقاضي إلى امتلاك حاسة الوصول إلى معرفة الحقيقة، والقانون وحده لايكفي للوصول إليها، إذ أن القانون مهما ارتقى لايمكن أن يتضمن كل الحق، ولذلك كان العمل القضائي ذو الهدف الانساني والاجتماعي هو وحده القادر أن يصل بواسطة القانون إلى إعطاء الحل العادل للمشاكل الإنسانية، وأن يجعل من القانون وسيلة لنصرة الحق وليس لخسرانه، ومن هنا تأتي الأهمية القصوى للعمل القضائي الذي نحاول عن طريق نشره إيصاله إلى كل رجل قانون بصفة عامة وكل قاض بصفة خاصة، ليكون نبراس ينير الطريق لهما نحو معرفة الحقيقة ويساعد الفكر القضائي على اختراق كل حاجز يعوق التفسير الجيد والواقعي للقانون. إن جمعية تنمية الابحاث والدراسات القضائية بهذا المعهد، سبق وأن قامت بنشر الاجتهادات القضائية المغربية في شكل مجموعات كقرارات محكمة استئناف الرباط في فترة ما قبل الاستقلال أو في شكل فهارس أو مجلات دورية، ولكنها اليوم تتقدم خطوة أخرى نحو نشر التوعية القضائية بشكل أكثر طموحا، وذلك عندما تقرر خلق سلسلة جديدة تعنى باجتهادات المجلس الأعلى قديمها وحديثها وتعمل على جمعها وتبويبها بشكل سهل المنال في مجموعات حسب المواد القانونية، ونقدم للقارىء الكريم أول مجلد لهذه المجموعة وهو ذلك المتعلق بالمادة المدنية، وكلنا أمل أن يجد القارئ فيها ما يطمح إلى معرفته ويتغاضى عن نقائصها بعد تنبيهنا إليها، فما كمل عمل إنسان من عيب، وإنما يشفع لنا أن هدفنا هو وضع مثل هذه الوسائل كأدوات للعمل من أجل عدالة فعالة قائمة على العلم والتجربة والمران طبق ما خططه لها صاحب الجلالة الحسن الثاني رحمه الله.
