في كتابه "تاريخ القانون وشريعة حمورابي" يتتبع الدكتور عباس العبودي نشأة القانون في المجتمعات الإنسانية الأولى وتطوره، كما يبحث في القوانين التي وصلت إلينا من العالم القديم بما فيها القانون الروماني والشريعة الإسلامية وشريعة حمورابي.
وفي هذا السياق يسلط الكتاب الضوء على العصور التي سبقت نشأة الكتاب في عصور ما قبل التاريخ، وأول تنظيم إجتماعي للأسرة والذي على أساسه نشأة "نظرية الأسرة الأبوية" ، و "نظرية القبيلة" و "نظرية العشيرة التوتمية" ، مع المقارنة بينها وبين نظرية الإسلام في تفسير قيام المجتمعات والقوانين التي تحكمها، إلى ذلك، يدرس الكتاب تاريخ تطور القانون الروماني العام ومصادره وخصائصه والعوامل التي ساعدت على انتشاره ومنها الديانة المسيحية، مع دراسة عامة لنظرية (الإلتزامات) في القانون الروماني، أما عن مصادر القانون في الشريعة الإسلامية فتمت دراستها بدءاً من مرحلة ما قبل ظهور الإسلام وذلك من خلال كتب الشعر والأدب لذلك قيل إن الشعر ديوان العرب، أي أنه سجلٌ لحياتهم وكتابٌ لتاريخهم، ومثله النقوش العربية التي دلّت على النظم التي سادت في هذه المدن سواء فيما يتعلق بالحياة الإقتصادية أو الإجتماعية أو السياسية أو الدينية، وأما في المرحلة التي ظهر فيها الإسلام فتمت الإضاءة عليها من خلال دراسة الشريعة الإسلامية والمبادىء العامة لنظام الحكم في الإسلام والنظام القضائي في الإسلام، وأخيراً دراسة عامة في شريعة حمورابي من خلال قانون الألواح الإثني عشري الروماني، ومتابعة ظروف صدور شريعة حمورابي وأسباب شهرتها، والإضاءة على مضمون شريعة حمورابي وطبيعتها القانونية ومصادر التشريع فيها.
