ظهرت فكرة التشريع في وادي الرافدين في وقت مبكر في التاريخ، وتطورت هذه الفكرة لتبلغ عند شريعة حمورابي أعلى مراحل تطورها القانوني. وبالرغم من من أن هذه الشريعة قد سبقتها قوانين أخرى في وادي الرافدين، مثل قانون أورنمو ولبت عشتار واشنونا، فإن شريعة حمورابي لا تزال هي النموذج المتكامل الذي وصلنا من وادي الرافدين بوصفه أفضل قانون قديم مكتشف لحد الآن في العالم القديم.
وهذه المحاضرات في شريعة حمورابي أعيد طبعها للمرة الثانية بعد أن نفدت الطبعة الأولى. إذ لا تزال معلوماتنا عن هذه الشريعة ناقصة وتحتاج إلى جهود كبيرة من أجل إظهارها على حقيقتها ولذلك عمد إلى اختصار بعض المواضيع وتعديل البعض منها، والهدف أن تكون هذه المحاضرات واضحة لطلاب كليات القانون. وقد تضمن الكتاب دراسة مقارنة مع التشريعات القديمة والحديثة، الغرض منها زيادة الثقافة القانونية لدارس القانون، لأن اقتصار دراسة القانون على الأحكام النافذة للقانون السائد، مجردة عن أصولها التاريخية، سوف يجعل دارس القانون ذا حرفة مجرداً من كل خبرة عملية، لا سيما وأن القوانين عرضة للتغيير في كل لحظة، وعليه فإن دراسة القوانين القديمة ومنها شريعة حمورابي تكون ثقافة قانونية واسعة لدى دراستها وتجعله قادراً على شرح القواعد القانونية وتأصيلها ومعرفة سيرتها وتطورها على تعاقب الزمن.
