إن مواد الأحوال الشخصية التي تثار في أقضيات الأسرة، غالبية أحكامها لله فيها حق، وهو حق الشرع، والقانونان فإن رقما 25/ 1920، 25/ 1929 تضمنا بعض أحكام هذه المواد- وليس كل ما يتعلق بها ويحكمها. ولذلك استقرت القواعد القانونية على أن كل مسألة من مسائل الأحوال الشخصية لم يرد بشأنها نص في القانون يطبق بشأنها الرأي الراجح في المذهب الحنفي.
ومواد الأحوال الشخصية- كما لا يخفى على أحد- ذات طبيعة خاصة لقيام الأسرة على مقتضى أحكامها، سواء في القانون أو في الشرع الإسلامي. لذلك رأينا أن نقدم هذه الموسوعة- خاصة بعد صدور القانون الصادر بالقانون رقم 1/ 2000 والقانون رقم 10/ 2004 بإنشاء محاكم الأسرة ليحكم الأسرة المصرية مسلمين وغير مسلمين. متضمنة أحكام الزواج، والطلاق والتطليق وآثارهما حتى يكون الأمر- بشأن ذلك كله- واضحًا في ظل نظام جديد تقوم عليه محاكم الأسرة، والنيابة الخاصة بها، وكذلك المكاتب التي تتولى حل مشاكل الأسرة المصرية المسلمة وغير المسلمة.
