تناول هذا البحث ثلاثة أمور أساسية: الأمر الأول: بعض القضايا التي تخدم أهداف البحث، ولها علاقة بموضوعه، ويستوجب السياق ذكرها ليكتمل بنيانه، وجاءت هذه القضايا من خلال التمهيد للبحث، وتم التطرق فيه إلى بيان مفهوم التجارة ومشروعيتها في الإسلام، والضوابط الشرعية في مجال المعاملات التجارية، ثم تعريف الأوراق التجارية وبيان أنواعها ونشأتها وخصائصها وأهدافها، وأخيراً الفرق بين الأوراق التجارية والمالية.
الأمر الثاني: نشأة الأوراق التجارية المعاصرة، وذلك ببيان تكييفها الفقهي وطبيعتها القانونية، فتم ذكر الشروط الشكلية والموضوعية لصياغتها وبنائها، ثم بيان الإطار التعاقدي لهذه الأوراق، وعلاقتها ببعض العقود في الفقه الإسلامي.
الأمر الثالث: التعامل في الأوراق التجارية، وذلك ببيان وسائل نقل الدين في الفقه الإسلامي، وتحويله من ذمة إلى أخرى، سواء عند المدين أو الدائن، فقد جرت العادة أن يتم التعامل بهذه الأوراق، إما بالتظهير أو الصرف أو الرهن أو التوكيل أو الوفاء، فقد بين المؤلف هذا الجانب إلى أي حد تتعارض هذه الأوراق مع الأحكام الشرعية بوجه عام، وإلى أي حد تنسجم مع الأحكام الفقهية والضوابط الشرعية.
وقد قسم المؤلف هذا البحث -بالإضافة إلى المقدمة- إلى تمهيد وبابين وخاتمة.
فتناول في التمهيد قضايا تتعلق بموضوع البحث، وعنوانه، وقسمه إلى ثمانية مباحث.
وتناول في الباب الأول: إنشاء الأوراق التجارية، وقسمه إلى أربعة فصول. وتناول في الباب الثاني: التعامل مع الأوراق التجارية المعاصرة، وقسمه إلى ستة فصول.
ثم ذيل الموضوع برمته بخاتمة بين فيها أهم ما تم التوصل إليه من النتائج خلال البحث.
