إن القانون المتعلق بتنظيم مهنة التوثيق جاء لمواكبة التطور الذي عرفته المهنة، وتحديثها وعصرنتها وإدماجها في المسار التنموي الذي يشهده المغرب، فضلا عن تجاوز الاختلالات التي يشوب جانبها التنظيمي، واستنساخ ظهير4 ماي 1925 المتعلق بتنظيم مهنة التوثيق والذي يحتوي على مواد أصبحت متجاوزة. ويتضمن القانون المتعلق بتنظيم مهنة التوثيق المكون من 134 مادة، العديد من المستجدات، أهمها إحداث هيئة وطنية للموثقين، تمارس اختصاصاتها بواسطة مجلس وطني ومجالس جهوية، والتنصيص على المباراة لولوج مهنة التوثيق، وإحداث معهد التكوين المهني للتوثيق، وإعادة تشكيل اللجنة المكلفة بإبداء الرأي في تعيين الموثقين ونقلهم وإعفاءهم، وإسناد الاختصاص في البت في المتابعات التأديبية إلى هذه اللجنة. كما ينص على أن تعيين الموثق يتم بقرار من الوزير الأول باقتراح من وزير العدل، بعد إبداء اللجنة المشار إليها لرأيها في الموضوع، ووضع مسطرة دقيقة لإجراء المتابعات التأديبية في حق الموثقين والمتمرنين، وإعادة تنظيم مسؤولية الموثق، وإلزام الموثق والمتمرن معا بالمحافظة على السر المهني، وتنظيم المشاركة المهنية بين الموثقين. وكان هذا القانون قد أثار جدلا وسط الموثقين، خاصة بالنسبة للجانب المتعلق بالمراقبة والتأديب، حيث طالب المهنيون بإسناد الاختصاص الرقابي والتأديبي. للموثقين أنفسهم بدل جعلها من صلاحيات النيابة العامة ووزارة المالية. ويأتي القانون الجديد، بعدما اجتازت مهنة التوثيق ظروفا عصيبة، إثر ارتفاع عدد الموثقين المتورطين في عمليات النصب والاختلاس والتزوير وخيانة الأمانة. فهو بمثابة محطة مفصلية في تأطير مهنة التوثيق يقطع مع الفوضى التي تعتري القطاع، ويجفف منابع الانزلاقات والاختلالات في اتجاه مزيد من الوضوح والشفافية و حماية مصالح المتعاملين مع المهنة.
