ان أهمية الموضوع المعالج تكمن في كون التقييد في الرسم العقاري يعطي الثقة للمالك وللغير أيضا من خلال حماية الحقوق المقيدة بالرسم العقاري ويمكن كل من له مصلحة في الاطلاع على الوضعية القانونية للعقار مما يؤثر بكيفية إيجابية على الاستثمار وتنشيط الحركة الاقتصادية المرتبطة بالاستثمار في الميدان العقاري . وقد انطلق الباحث من طرح إشكالية أساسية مفادها : " الى أي حد استطاع المشرع المغربي من خلال التعديلات التي طالت ظهير التحفيظ العقاري بمفتضى القانون 07-14 أن يوفر حماية كافية للملكية العقارية من خلال الزامية التقييد بالرسم العقاري ؟ " وانطلاقا من الإشكالية السابقة استعرض الباحث الدور الذي يلعبه المحافظ العقاري بشأن التقييدات موضحا الحقوق الخاضعة للتقييد بالرسم العقاري وكذا آجال التقييد ومسطرته مستعينا في هذه الدراسة بمختلف المناهج العلمية معتمدا التقسيم الثنائي في تناول مختلف العناصر والأجزاء المشكلة للبحث . واعتمد الباحث على العديد من المراجع باللغتين العربية والفرنسية العامة منها والخاصة ،وكذلك العديد من الأبحاث الجامعية من مستوى الأطاريح والرسائل الجامعية بالاضافة الى عدة مقالات ودراسات وندوات ، كما استعان الباحث بعدة اجتهادات قضائية منشورة وغير منشورة ووظفها بشكل جيد ، ونهج الباحث من تارة لأخرى أسلوب المقارنة على مستوى التشريع أو القضاء أو الفقه ،والدراسة المقارنة لها أهميتها في الأبحاث والدراسات العلمية .
