لا يخفى ما للعلامة التجارية من أهمية كبيرة في الوقت الحاضر، سواء في النشاط الإقتصادي أو التجاري، كونها تعد وسيلة المنتج او التاجر أو مقدم الخدمة لتمييز منتجاته أو بضائعه أو خدماته عما يماثلها أو يشابهها من منتجات أو بضائع أو خدمات منافسة.
ولهذا كان هذا الموضوع محط إهتمام الباحث للبحث فيه والغوص لسير أعماقه للكشف عن مكنوناته، والتعرف على مدى توفر الحماية الجزائية للعلامة التجارية سواء في قانون العلامات التجارية الأردني أم في التشريع المقارنة، خاصة وإن غالبية من تناول موضوع الملكية الفكرية ومنها العلامة التجارية كان يبحث فقط في نماذج الجرائم دون الغوص في الجانب الإجرائي لهذه الحماية.
وقد اجتهد الباحث في تسليط الضوء على أهم النصوص القانونية في قانون العلامات التجارية الأردني وتشريعات العلامات التجارية المقارنة، وحاول جاهداً تحليل البعض منها والتعليق على البعض الآخر.
كما حاول الباحث بيان مواقف الفقه والقضاء من غالبية المسائل المتعلقة بتوفير الحماية الجزائية للعلامة التجارية، مستعيناً بآراء الفقه والشراح من المسائل الخلافية وفق منهج علمي قانوني.
كما وضع الباحث يده على كثير من المسائل المتعلقة بهذه الدراسة رغم كل ما كتب من دراسات وأبحاث في العلامات التجارية، إذ لم تكن تلك الدراسات تتناول الحماية الجزائية للعلامة التجارية بالشكل الذي تناوله الباحث، حيث أن تلك الدراسات كانت قد تناولت العلامة التجارية من خلال التركيز على الجانب التجاري ودعوى المنافسة غير المشروعة، وإذا كانت بعض تلك الدراسات قد تناولت جرائم التعدي على العلامة التجارية فإنها تناولتها دون تعمق، حيث لم تركز تلك الدراسات على مدى توفر الحماية الجزائية للعلامة التجارية بشقيها الموضوعي والإجرائي.
