إن تجاوز أو رفض القيم التي اتفق عليها غالبية أفراد المجتمع. يعتبر جريمة، ذلك أن القانون هو قانون هذا المجتمع، وبالتالي فهو دائماً على صواب والمجرم دائماً على خطأ، لكن هذا الخطأ نسبي، لأنه خطأ بالنسبة لهذا المجتمع، وفي هذا الوقت، فمعايير الخطأ والصواب متغيرة بتغير القيم الاجتماعية والثقافية والسياسية...مهما كانت الأسباب، فإن الظاهرة الإجرامية موجودة في كل مجتمع ، وأي مجتمع يجد مضطراً لمحاربتها ولكن بأي سلاح؟ بالقضاء على أسبابها أم بالقضاء على الفرد نفسه؟ لقد حاول علماء الإجرام إيجاد إجابات مرضية على هذه التساؤلات لكن لا نراهم يتفقون على واحدة منها، فعلم الإجرام قائم على الشك والاجتهاد. ومدارس فقه علم الاجرام، والسياسة الجنائية، تحاول منذ ما يزيد على القرن، أن توقف بين علم النفس وعلم الاجتماع وعلم الأحياء، وهي عناصر علم الإجرام، ولكن لا نرى أن ذلك ممكن في المستقبل المنظور. مما يعني أنه علينا دائماً أن نعيد التدقيق في نظرتنا للجريمة وللمجرم.
