إذا كانت مسألة نفاذ المعاهدات الدولية في النظام القانوني الداخلي للدول مسألة محل جدل ونقاش كبيرين، فإن الرقابة على دستورية المعاهدات الدولية قبل وبعد نفاذها هي مسألة أصعب وأكثر تعقيداً وجدلاً، وذلك لارتباطها الوثيق بما يسمى الأعمال السياسية أو أعمال السيادة والتي لا تذكر إلا ووقعنا في خلافات وجدالات لا تنتهي في غالب الأحيان برأي واضح يتفق عليه الجميع.
فإذا كان الدستور هو القانون الأسمى في الدولة، فإن قواعده بالضرورة هي أعلى القواعد القانونية مرتبة، وبالتالي فإن جميع التشريعات والقوانين (بما فيها المعاهدات الدولية النافذة في النظم القانونية الداخلية) يجب أن تخضع للدستور وأحكامه، وذلك تحقيقاً لمبدأ سيادة الدستور وتماشياً مع مقتضيات مبدأ المشروعية والذي فحواه خضوع جميع السلطات في الدولة وكذلك الأفراد لأحكام القانون الذي يحتل الدستور أعلى هرمه.
ولما كانت أهمية المعاهدات الدولية تتزايد يوماً بعد يوم، ومواضيعها تتشعب وتزداد خطورة في بعض الأحيان، أصبح لزاماً على دارسي القانون بصفة عامة، وعلى المتخصصين في القانونين الدستوري والدولي العام، معرفة مدى التوافق بين المعاهدات الدولية المبرمة وبين أحكام الدستور سواء من الناحية الشكلية أو من الناحية الموضوعية.
وانطلاقاً من ذلك فإن موضوع هذا البحث سوف يتمحور حول المعاهدات الدولية والرقابة على دستوريتها وذلك في كل من القانون المصري والقانون الجزائري، لذلك فقد تم اختيار عنوان مناسب لهذا الموضوع والذي هو: "الرقابة على دستورية المعاهدات الدولية في التشريعين المصري والجزائري.
وعلى هذا سوف يتم تناول ما سبق في فصل تمهيدي: المعاهدة الدولية في القانون الدولي العام، وفصلين هما: المعاهدة الدولية في ميدان الرقابة على الدستورية، واتصال القضاء الدستوري بالمعاهدات الدولية.
