قد لا أكون مبالغاً إذا قلت بأن الرغبة في الكتابة بموضوع القانون الدولي الخاص تولدت لدي منذ فترة طويلة نوعاً ما، تمتد إلى أيام دراسة الماجستير نظراً لما تتمتع به هذه المادة من جاذبية كبيرة لمعظم الباحثين كونها تعتمد على التحليل والفهم القانوني السليم للنصوص والآراء الفقهية ذات الصلة. وعلى الرغم من الحقيقة السابقة إلا أن الرغبة في الكتابة في هذا الموضوع الشيق لم تتبلور فعلياً إلا بعد ان تشرفت بتدريس مادة القانون الدولي الخاص ولأكثر من فصل دراسي كمقرر على طلبة كلية الحقوق في جامعة عمان الأهلية، وكان لهذا التبلور أكثر من سبب، لعل أهمها على الإطلاق هو عدم وجود فقه أردني في هذا الموضوع على الرغم من أن أحد مصادر هذا القانون يتمثل في فقه هذا القانون الجديد والمتجدد يوماً بعد يوم، وما يؤكد صحة ملاحظتي أنني لم أجد أي مرجع اردني التأليف على رفوف المكتبات القانونية الأردنية على الرغم من وجود بعض الزملاء الأفاضل المتخصصين في هذا فرع من فروع القانون الخاص. ومن أسباب تبلور فكرة الكتابة في موضوع القانون الدولي الخاص هو عدم لم شملها في موسوعة أو مجموعة او مؤلف واحد، لا بل دراستها بصورة مجزأة غير مكتملة مما يبعد الطالب عن فحوى هذا الموضوع وعدم تلمس جوهره وأبعاده بشكل صحيح ومنهجي ، فكثير من الطلاب يدرسون هذه المادة من خلال دراسة مادة الجنسية وبعضهم يدرسونها من خلال دراسة مادة تنازع القوانين وبعضهم يدرسونها من خلال كل من فكرتي التنازع والجنسية تاركين موضوعات كالاختصاص القضائي الدولي وتنفيذ الأحكام الاجنبية والموطن ومركز الاجانب إلى محض الصدفة فإذا اتسع الفصل الدراسي درسوها وإلا فلا!!. لهذا وذاك قررت بعد الاتكال على الله عز وجل ان أبادر بوضع هذه الموسوعة كمحاولة للم شمل موضوعات القانون الدولي الخاص، آملاً من عميق قلبي أن تشكل خطوة أولى نحو إيجاد فقه أردني متخصص في إطار هذا القانون ، فمن حق كل دولة سواء عربية أو غربية ان يكون فيها فقه متخصص في كل مناحي العلوم القانونية ينير الطريق للدارسين والباحثين ويساعد القضاة والمحامين وعامة رجال القانون في إدراك معاني ومغازي هذا القانون.
