يرتبط الحق في التأمين الإجتماعي بممارسة نشاط بأجر أو بصفة عامة ممارسة نشاط حرفي أو مهني، وحيث يكون هذا النشاط هو أساس الحق، وما يتقاضاه من أجر أو دخل هو معيار تحديد مدى الحق، والحماية الإجتماعية المتمثلة في التأمين الإجتماعي تعتبر المقابل المعقول لمساهمة الشخص في حياة المجتمع وما بذله من جهد وعمل من أجل المجتمع.
وعلي هذا ينظر للتأمين الإجتماعي علي أنه النظام أو الوسيلة التي تكفل وتضمن للشخص الداخل الناتج عن نشاطه الحرفي أو المهني، بحيث يحل المعاش أو التعويض محل ما يفقده المؤمن عليه من أجر من دخل، وعلي هذا فإن حجر الزاوية في هذا الإتجاه أو اساس التأمين الإجتماعي يكمن في ما يقوم به الشخص من نشاط حرفي أو مهني وما يقدمه للمجتمع. والتأمين الإجتماعي بهذه الصورة يعتبر حقاً للعاملين في المجتمع بوصفها وليس باعتبارها من الأفراد في المجتمع.
وفي مصر لا يجب أن تفهم عبارة قانون التأمين الإجتماعي علي أنها قاصرة علي القانون رقم 79 لسنة 1975. فهذا القانون كما أوضحنا سلفاً لا يكون إلا الأصل العام لنظام التأمين الإجتماعي، ولكن يكمله باقي القوانين. ومن مجموع هذه القوانين يتكون قانون التأمين الإجتماعي المصري بالمعني العلمي.
وهذا القانون يوفر للمستفيد منه الحماية ضد كافة المخاطر التي يتعرض لها العامل في المجتمع، أي ضد المخاطر الإجتماعية.
وندرس في باب تمهيدي نطاق تطبيق القانون، ثم نفرد باباً مستقلاً لكل نوع من أنواع التأمينات التي يوفرها القانون للمؤمن عليه.
