إذا كانت جرائم الحرب تمتد إلى أغوار سحيقة في التاريخ، فإن جرائم العدوان لم تتبلور لحد الآن. فلا تزال موضع جدل ونقاش، بسبب اختلاف الدول واختلاف النزاعات السياسية. لهذا فقد نص نظام روما الأساسي للمحكمة الجنائية الدولية على تفاصيل حول جرائم الحرب، في حين لم يفصل ذلك بالنسبة لجرائم العدوان، لأنها موضع نقاش وجدل بين الدول. وإذا كانت جرائم الحرب يرتكبها جنود أو أشخاص عاديون، فإن جرائم العدوان ترتكب من قبل الدولة، وقد يشترك في ارتكابها البرلمان ومجلس الوزراء والقوات المسلحة، فمن الصعوبة تحديد المسؤولية في ارتكاب جرائم العدوان. لهذا فإن نظام المحكمة لم يرد تفاصيل حول ذلك، ولم يحدد المسؤولية الجنائية فيها بشكل واضح. وإنما أحال تحديد جرائم العدوان بالتنسيق مع ميثاق الأمم المتحدة وبشكل خاص مع مجلس الأمن، عندما ينظر في تعديل نظام روما الأساسي للمحكمة الجنائية الدولية. ويصعب في العديد من الأحيان الفصل بين جرائم الحرب، وجرائم العدوان، بسبب التداخل بينها، والتشابه فيما بينها. وجرائم الحرب والعدوان، من أكثر الجرائم التي تفتك بالإنسان، وبخاصة بعد تطور أسلحة الدمار الشامل، وبالأهداف الدنية، والأهداف العسكرية التي تسبب فواجع مدمرة بالمدنيين، وبالأجيال القادمة. وتختص المحاكم الوطنية بالنظر في جرائم الحرب وجرائم العدوان، كما تختص محكمة الجنايات الدولية بالنظر في هذه الجرائم في حالة عدم قيام المحاكم الوطنية، أو عجزها بالنظر فيها، كما تختص المحاكمة الدولية المؤقتة التي تشكل بقرار من مجلس الأمن، بالنظر فيها ومعاقبة القائمين بها. وإذا كانت جرائم الحرب غالباً ما تتخذ طريقها نحو المحاسبة القانونية، عندما يتمكن المنتصر من فرض إرادته على الطرف المستسلم، وينشئ محاكم لفرض العقوبات على المندحر، فإن جرائم العدوان لا تزال بيد مجلس الأمن الذي يعود إليه وحده في تقرير الأفعال التي تعود جرائم، والعقوبات التي يقررها بحق من يراه أنه ارتكب عدواناً، طبقاً لقرار الجمعية العامة الخاص بتعريف العدوان وتحديد حالاته، أو دون ذلك.
