قانون الأسرة يتناقص دوره في بناء المؤسسة التي تشكل العمود الفقري لمجتمع الإنسان كما تراجع أثره في ضبط العلاقات بين أفرادها. يرجع ذلك إلى تيارين قويين كلاهما يبدو مبالغا فيما يدعو إليه : - التيار الأول يتمسك بأوضاع أنتجتها ثقافة أعراف وتقاليد (انظر في الفقرتين 288 و289 مقولتي : فيتاغورس والرازي عن المرأة ) طال عليها الأمد فتعالت عن النقاش، وتترست براية حماية العرين، والدفاع عن الحريم ومقاومة الشر المستطيل الوافد مع الغريب الدخيل. - والتيار الثاني لا يكاد يبقي من الأسرة إلا الاسم أما عناصرها الأساسية ومقوماتها الأخلاقية، فقد تلاشت في ركام "الحقوق" التي كتب لها "النصر المبين" على الواجبات والالتزامات ... حتى أصبح من المألوف التخلي عن الأبناء وانتهاء الشعور بقدسية وحميمية النسب، وإيداع الآباء في الملاجئ ودور العجزة، اما علاقة الأخوة والعمومة والمصاهرة فقد أصبحت في خبر كان ...قيم الإنسان الأساسية تكتسب وتمارس داخل نظام الأسرة وبفضل هذا النظام، فإذا استحال إلى مجرد تجمع نفعي عابر كانت العاقبة وخيمة على كل مجتمع الإنسان. البوادر حاضرة وفي ذلك عبرة لأولي الألباب. أثناء تحرير مشروع مدونة الأسرة قيل ان استعمال عبارة "عقد الزواج" في موادها بدل "عقد النكاح" "محاولة غبية يراد بها غسل مدونة الأحوال الشخصية من كل لفظ يشعر بأن لها صلة بالقرآن، وصولا بذلك إلى أن تكون المدونة في صورتها الجديدة مبتوتة الصلة بمصادر التشريع التي يستنبط منها المسلمون ". ومعروف ما يطالب به التيار المقابل وينشر بكل وسائل النشر المتاحة
