يعد الزواج الرابطة الأساسية في تكوين الأسرة وتشكيل المجتمع، وقد اهتمت التشريعات الوطنية بتنظيم هذه العلاقة الإنسانية في جميع جوانبها متأثرة في ذلك بالتعاليم الدينية والقيم الأخلاقية والأعراف السائدة في مجتمعاتها الوطنية، ونظراً لاختلاف هذه المفاهيم من دولة إلى أخرى فقد اختلفت تبعاً لذلك التنظيمات الخاصة بالرابطة الزوجية من دولة إلى أخرى. والنظام المالي للزوجين من جوانب الزواج التي اهتمت التشريعات الوطنية بتنظيمها والتي خضعت للاختلاف السابق. ونقصد بذلك علاقة كل من الزوجين بأمواله وبأموال الزوج الآخر وعلاقتهما معاً بالأموال المشتركة بينهما، وكذلك علاقة كل من الزوجين بالديون المترتبة بذمته والديون المترتبة بذمة الزوج الآخر وعلاقتهما معاً بالديون المشتركة المستحقة عليهما، وتحديد التزام أحد الزوجين بالإنفاق الزوجي وحده أو التزام أحدهما بالإنفاق ومساهمة الآخر في ذلك أو التزامهما معاً في الإنفاق. والنظام المالي للزوجين له عدة أشكال أهمها نظام انفصال الأموال بين الزوجين ونظام الاشتراك في الأموال المكتسبة بين الزوجين.
