يمثل البحر أهمية قصوى بالنسبة للمجتمع الإنساني في العالم بأسره. وقد شهد العاملون في البحر منذ زمن طويل بحاجتهم الملحة إلى وضع تنظيم قانوني للعلاقات الناشئة عن نشاطهم البحري بما يتلاءم مع طبيعة وظرف مسرح الحياة البحرية. ويذهب الفقه في عمومته إلى تعريف القانون البحري بأنه مجموعة القواعد القانونية المتعلقة بالملاحة البحرية. هذا وينقسم القانون البحري بمعناه المتقدم إلى قسمين رئيسين هما القانون البحري العام والقانون البحري الخاص. أ-القانون البحري العام: ويشمل هذا القانون مجموعة القواعد القانونية المتصلة بالملاحة البحرية والتي تظهر الدولة في علاقاته بوضعها سلطة عامة ذات سيادة. ويندرج تحت هذا القسم ثلاثة فروع رئيسية: 1-القانون الدولي العام البحري. 2-القانون الجنائي البحري. 3-القانون الإداري البحري. ب-القانون البحري الخاص. ويقصد بهذا القانون مجموع القواعد القانونية المتصلة بالملاحة البحرية والتي تنظم العلاقات فيما بين الأفراد والهيئات الخاصة. ويتفرع عن هذا القانون ما يلي: 1-القانون الدولي الخاص البحري. 2-القانون التجاري البحري. هذا وسوف تنصب الدراسة في هذا المؤلف على قواعد القانون التجاري البحري مع الإشارة إلى بعض أحكام فروع القانون البحري الأخرى كل في موضعه.
