فكانت فكرة القانون الطبيعي تعبيراً عن أمل المفكرين بوجود قواعد قانونية، أبدية، خالدة ثابتة، تصحَ في الزمان والمكان، أسبق من القانون الوضعي وأسمى، يميلها العقل السليم ويستقر عليها الضمير الإنساني والحس الإجتماعي، ليست من خلق الإنسان وإنما وليدة قوة مهيمنة غير منظورة، للإهتداء بها وتكون المثل الأعلى لكل تشريع وضعي، يكون أقرب للكمال كلما اقترب من تلك القواعد، لأنها توحي بمقاييس مطلقة للخير والشر والحق والعدل.
