شكلت أحكام الزواج والطلاق وحقوق المرأة في الإسلام مادة سجال ونقاش بين مؤيّد ومعارض، وكانت النافذة التي أطل منها المنتقدون لوضع المرأة القانوني، وجاهروا بضرورة تعديل هذه التشريعات بما يضمن حقوق الزوجة، ويواكب التطورات الثقافية والاجتماعية المتسارعة.
يعالج هذا الكتاب نظرة التشريع الإسلامي إلى الزواج والطلاق وتعدّد الزوجات، ويبحث أحكام زواج المسلمين بغير المسلمين وزواج المتعة والتسرّي بالإماء ويعرض آراء فقهاء المذاهب الإسلامية منها. ويتطرق إلى وجهات نظر الكتّاب والمفكرين المسلمين المعاصرين من هذا الموضوع، وتقييمهم له.
ويعرض الكاتب حقوق كل من الزوج والزوجة ضمن أحكام الزواج في الفقه الإسلامي. ويناقش مواد القوانين الحديثة للأحوال الشخصية المعتمدة في أكثرها على آراء الفقهاء القدامى، وتأثيرها في وضع المرأة المسلمة المعاصرة.
ويطالب بمساوة المرأة بالرجل في القانون، لأن قيم عصرنا الحاضر تفرض هذه المساواة وتبرّرها، و"يحرض"، لذلك، السلطات السياسية على نزع سلطة المنع والإقرار والمراقبة في مجال الأحوال الشخصية من أيدي رجال الدين، وجعل هذا المجال ـ كبقية القوانين المدنية ـ من اختصاص مؤسسات الدولة العلمانية.
