كان أمر اتخاذ الرهائن شائعا في العصور القديمة والوسطي كصورة لتنفيذ المعاهدات والاتفاقيات ولفرض الطاعة والولاء وقد يتم حبس الرهائن ليتم فك أسرى عند الطرف الثاني ، وأخذ الرهينة يكون مشروطا ، وأما احتباس الأسير لا يلزم أن يكون مقابل حق ولفظ الرهينة في الدراسة يطلق على (الرجال والنساء والأطفال ) أما لفظ الأسرى : يطلق على الرجال المقاتلين ، أما لفظ السي: يطلق على من يظفر به المسلمون حيا من نساء أهل الحرب وأطفالهم والأسرى لا يؤخذون باتفاقيات وعهود ، ولكن يتم أسرهم عند وجود حرب قائمة ، أو متوقعة أما الرهائن فيؤخذون في أغلب الأحيان عن طريق معاهدات واتفاقيات . وقد اتخذ قادة فتح بلاد المغرب رهائن كثيرة ليضمنوا ولاء قبائل بلاد المغرب ، فأسلم هؤلاء الرهائن وتشربوا الدين الإسلامي ومبادئه وحسن إسلامهم فكانوا نواة الجيش الذي فتح به طارق بن زياد الأندلس ، لكن الأسرى لهم احكام خاصة، وسوف يتضح ذلك من خلال هذه الدراسة .
