يرتبط الأفراد فيما بينهم بعلاقات تنظمها القوانين وفي كل دولة يوجد عدد من الأجانب يرتبطون مع أبناء الدول التي يعيشون فيها بعلاقات قانونية ومن هنا جاء التعقيد في العلاقات القانونية حيث أن لكل مجتمع قوانينه الخاصة، وله سلطته الخاصة. وقد أدى الاختلاف بين قوانين الدول وأنظمتها إلى حصول نزاع بين تلك القوانين وقد اصبح هذا النزاع علماً شائعاً. ويمكن أيضاً أن يثور التنازع بين القوانين ليس فقط بشأن القانون وإنما بشأن السلطة الاختصاص أيضاً.
ويظهر تنازع القوانين في ثلاث صور: تنازع القوانين، وتنازع السلطات، وتنازع الاختصاص. وقد سعي علماء القانون إلى وضع قواعد عالمية تعتمدها جميع الدول لفض النزاع الناشئ عن التنازع بصوره الثلاث. والدكتور حسن الهداوي يضع في هذا الكتاب ما نظمه المشرع الأردني في هذا الموضوع، وهو يقدم لدراسته بالمبادئ العامة في تنازع القوانين لمعرفة مدلوله، وشروط قيام التنازع ونطاق هذا التنازع حيث يتعرض لكل ذلك في الباب الأول.
أما في الباب الثاني فيعرض فيه لتنازع الاختصاص القضائي والقواعد العامة في الاختصاص القضائي والاختصاص القضائي في القانون الأردني وكيفية سير المرافعات في الدعوى. وعرض في الباب الثالث لتنفيذ الأحكام الأجنبية وآثار تلك الأحكام وتنفيذها في المملكة الأردنية وشروط تنفيذ الحكم الأجنبي.
