إن البث الفضائي موضوعاً بكراً حيث يبدو تقني لا يتاح الدخول اليه والتعامل معها سوى للملمين بها كلياً أو جزئياً على أقل تقدير، إذ هي تستعمل لغات مبطنة وسرية ومصطلحات غير مألوفة قد لا يتفق أهل الإختصاص بشأنها دائماً.
ولعل هذا الواقع هو ما عزز ولا يزال يعطى احتمالات قيام عقود واتفاقيات تختص بالبث الفضائي، وتكون ذات طبيعة متأرجحة يكتنفها الشك ويشوبها الغموض وتتضمن أحكاماً غير منتظمة وبنوداً تقنية، وهذا ما يفرض على المحاكم في معظم الأحيان نقل اكتشاف إرادة الأطراف وتبيان حقيقة نواياهم، ويساعد دورها في تفسير هذه العقود ومنحها الوصف القانوني الملائم.
