وخلاصة الرأي الذي أجمعت عليه جميع كتب علماء أهل السنة في هذه المسألة: أن ولد الزنا لا يُنسب إلى أبيه الزاني، بل يُنسب إلى زوج المرأة إن كانت متزوجة، وإلى أمه إن لم تكن متزوجة، فليس للأب الذي من صلبه هذا الولد الحق فيه أبدًا، وليس للولد الذي هو من صلب ذاك الرجل الحق في أبيه!
يقول الإمام النووي مفسرًا الحديث الشائع: «الولد للفراش وللعاهر الحجر»(): «معناه إذا كان للرجل زوجة أو مملوكة صارت فراشًا له فأتت بولدٍ لمدة الإمكان لحقه وصار ولدًا له، يجري بينهما التوارث وغيره من أحكام الولادة، سواء كان موافقًا له في الشبه أو مخالفًا له»().
