الإجماع قطب الدين، ومناط الأحكام، ونظام الإسلام، ومعتصم المسلمين في كل زمان ومكان.
وذلك لأن معظم مسائل الشريعة قد خلت من نصوص صريحة فأصبحت مجتهدات في حيز الإختلافات.
والأصل في الشريعة الإجماع بعد الكتاب والسنة، وهو حجة الله تعالى على خليقته، وقد يتساءل سائل: كيف يكون الإجماع حجة قاطعة في الشرع وليس في كتاب الله تعالى نص في إثبات الإجماع غير قابل للتأويل وكذلك الشأن في سنة رسول الله صلى الله عليه وسلم، فإنه لم يتواتر عنه صلى الله عليه وسلم نص في الإجماع يدرأ التجويز ويقطع المعاذير.
وإذا كان ذلك كذلك فما هو مستند اليقين والقطع بثبوت الإجماع في الشرع، طالما لم نجد له مسلكاً معقولاً، وأصلاً في السمع مقطوعاً به ومنقولاً.
