لما كان للطلاق آثار شرعية واجتماعية على العلاقة بين الزوجين من حيث حلها وحرمتها وبالتالي استمرارها أو وجوب قطعها فإن الفتوى في نوازله من الخطورة بمكان، ولهذا يتوجب توافر ضوابط في المستفتي فيها وفي من يفتي فيها، إذ على المستفتي تصوير الواقعة تصويرا دقيقا كاشفا عن حقيقتها دون تجهيل أو تحيل وعليه التوجه لطلب الفتوى ممن عرف بالورع والاستقامة وتحاشي أخذها من الكتب ومواقع الانترنت، أما المفتي فيتوجب أن يكون عالما بالأحكام الشرعية والقانونية للطلاق وبأعراف البلد وعادات أهله وعليه الالتزام بالوسطية في الفتوى وعدم التعصب لمذهب أو قول بعينه مع تحاشي تتبع الرخص والتلفيق بين الأقوال الفقهية مع مراعاة أن تحقق فتواه مقاصد الشريعة والتيسير على الزوجين والستر عليهما ما أمكن.
