Book Description
القانون هو تلك القواعد العامة المجردة التي تنظم سلوك األشخاص وعالقاتهم في المجتمع وتكون
مصحوبة بجزاء توقعه السلطة العامة عند االقتضاء. ويخضع للقانون كل سكان الدولة ويطبق على كافة
إقليمها.
واألصل في تطبيق قانون الدولة هو اإلقليمية، أي أن قانون الدولة يطبق على كل ما يقع داخل إقليمها
الدولة ال يمكنها أن تطبق

من وقائع قانونية بغض النظر عن جنسية أشخاصها أو موطنهم، وهو ما يعني أن
قوانينها على مواطنيها خارج إقليمها. واستثناء من هذا المبدأ ظهر مبدأ شخصية القوانين ومقتضاه أن قوانين
الدولة تطبق على مواطنيها في أي دولة كانوا. وقد أخذت الجزائر بمبدأ اإلقليمية كأصل وبمبدأ الشخصية
كاستثناء.
ومن حيث األصل ال تثور أية مشكلة حين يكون أط ارف العالقة القانونية ج ازئريين ومكان نشوء العالقة
القانونية في الجزائر وموضوع العالقة أو محلها موجودا في الجزائر. ألن القانون المطبق في هذه الحالة هو
القانون الج ازئري. ولكن إذا كان أحد هذه العناصر الثالثة )األطراف/المكان/ المحل( غير ج ازئري، يثار التساؤل
عن القانون واجب التطبيق على القانونية التي نشأت وعن المحكمة التي من شأنها أن تفصل في النزاع الناشئ
عن هذه العالقة القانونية.
