Book Description
يتحتم علينا ونحن في محراب القانون الوضعي، تشريح هذا المصطلح الفقهي بلغة القانون وأوالياته ومبضعه، فمن المعلوم أن الفن اللغوي أو الصياغي – كما تقدمه لنا النظرية العامة للقانون- يميّز الصياغة الدقيقة والجامدة من الصياغة المرنة.
ففي الصياغة الدقيقة يضبط القانون المفهوم ويحدد عناصره تحديداً دقيقاً، ومن مظاهر ذلك السلطة المقيدة للإدارة، وبالمقابل فقد يعمد القانون إلى تحديد نماذج مرنة أي معايير عامة، ا سيما أن القانون هو أحد القوانين المعيارية، ومظهر ذلك على صعيد القانون الاداري السلطة التقديرية، ففي السلطة التقديرية تعطى الادارة صلاحية اتخاذ عدة قرارات كلها تعتبر مشروعة.
في نظرنا إن هذا التعريف ينطبق على الرخصة كجهاز مفاهمي في الشريعة الاسلامية، وبمقابل الرخصة العزيمة ألا وهي السلطة المقيدة والمثبطة والمحددة للأحكام، وهذا ما يتضح جلياً في قوله صلى الله عليه وسلم: "إن الله يحب أن تؤتى رخصه، كما يحب أن تؤتى عزائمه".
وفي نظرنا أن الجهاز المفاهمي في الشريعة الاسلامية يقارب المعنى المصطلحي في القانون الاداري، وإن كان لا يتطابق معه، والمطلوب تحديد ماهية الرخصة في هذا القانون.
